When the case is under trial by the military court, if the accused is unable to defend himself due to insanity, or if it is believed that the accused has committed such an offense due to his insanity, the nature of the act and that the act is unfair and against the law due to his insanity, the military court shall issue a notice in that regard. (2) The chairman of the military court or in the case of the summary military court, the pretrial officer shall immediately submit the form prepared in accordance with sub-section (1) to the officer who decides the case or to the officer as per sub-section (3) of section 115.
(3) If the report received according to sub-section (2) is not approved by the officer who approves the case, he may take necessary action to have the case of such accused tried by the same or another military court.
(4) If the summary military court approves the behavior mentioned in the pamphlet submitted in accordance with sub-section (2), the approving officer shall order the detention of the accused and submit it to the Government of Nepal, Ministry of Defense for approval.
(5) After receiving the report in accordance with sub-section (4), the Ministry of Defense may order the accused to be detained in an insane asylum or any other suitable safe place.
